These Terms of Use ("Terms") govern your access to and use of the kayadevelopment.com website, its content, and any online tools we make available through it (the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who we are
The Services are operated by Kaya Development. Our registered office and contact details are available on the Contact page. Where these Terms refer to "we", "us", or "Kaya", they refer to Kaya Development.
2. Use of the Services
You may use the Services for lawful purposes, including reading our publications, contacting us, applying for roles, subscribing to newsletters, and using free assessment tools such as Brand Check-Up. You may not (a) reverse-engineer, scrape at scale, or attempt to derive source code; (b) interfere with the operation or security of the Services; (c) use the Services to harass, defame, or harm any person or entity; (d) misrepresent your identity or affiliation; or (e) use the Services to violate any applicable law.
3. Intellectual property
All content on the Services — articles, reports, exhibits, tools, brand assets — is owned by Kaya Development or its licensors and is protected by applicable copyright, trademark, and other intellectual-property laws. You may read, share, and link to our publications. You may quote from them for non-commercial, non-misleading purposes with appropriate attribution. You may not reproduce them in full, repackage them, or use them to train machine-learning models, without our prior written consent.
The "Kaya Development" name and logo are trademarks. You may not use them without our permission.
4. Reports, articles, and data exhibits
Our reports, articles, and data exhibits are provided for general informational purposes. They are not advice for any specific transaction, investment, or operational decision and should not be relied upon as such. Some exhibits incorporate data from third-party sources (such as the World Bank Open Data API), used under those sources' terms; we credit them where used. We make reasonable efforts to ensure accuracy but do not warrant that any specific figure is current or error-free at the time of your access.
5. Free tools (Brand Check-Up, Development AI demo)
Free assessment tools and demos we offer through the Services are provided "as is", without warranties of any kind. Use of paid versions of Development AI is governed by a separate subscription agreement that supersedes the relevant parts of these Terms.
6. Submissions
If you submit content to us through forms (job applications, assessment responses, contact messages), you grant us a non-exclusive, royalty-free license to use that content for the purposes for which you submitted it — for example, to evaluate your application or respond to your enquiry. You retain ownership of your submissions. Do not submit content that you do not have the right to share.
7. Third-party links
The Services may link to third-party sites or services. We do not control them, do not endorse them, and are not responsible for their content or practices.
8. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Kaya Development and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury arising from negligence, or for fraud.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason consistent with these Terms or applicable law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.
11. Changes
We may update these Terms from time to time. Material changes will be notified on this page with a revised "last updated" date. Continued use of the Services after a change constitutes acceptance of the updated Terms.
12. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved by the competent courts of Ankara, Türkiye, except where applicable consumer-protection laws require otherwise.
